California Vehicle Code Section 23154 is a new law that just went into effect on January 1, 2009; it allows the DMV to take your driving privileges away for 1 full year if:
- You are on probation for VC 23152 or VC 23153, and
- You are caught driving with a BAC of 0.01 or more
The good news is that you are entitled to a DMV hearing (if the hearing request is made within 10 days of the arrest or detention) and the DMV will then have to prove the case against you.
