NEW LAW ADVERSELY AFFECTS EVERYONE CURRENTLY ON PROBATION FOR DUI
California Vehicle Code Section 23154 is a new law that just went into effect on January 1, 2009; it allows the DMV to take your driving privileges away for 1 full year if:
- You are on probation for VC 23152 or VC 23153, and
- You are caught driving with a BAC of 0.01 or more
The good news is that you are entitled to a DMV hearing (if the hearing request is made within 10 days of the arrest or detention) and the DMV will then have to prove the case against you. Mindy McQueen has handled 1000s of DUI cases and DMV hearings, and will do everything possible to keep your driving privileges intact.
She can help you, regardless of the county in which you were detained. There are a number of defenses available that Ms. McQueen will utilize in order to give you the best shot at retaining your privilege to drive.
