Veterans Court
If you have ever served in the military, thank you for your service. Please call me so that we can discuss the wonderful options in Veterans Court, that your service has entitled you to pursue. First time DUI cases, and even some second or subsequent DUI cases generally result in Diversion with counseling. Diversion means that you get a shorter probationary period, and you will not have to pay any fines or fees to the court, nor will you have to serve any jail time. Contrast that with the outcome for first offenders who do not qualify for Veterans Court. They will often be facing three to five years of probation (formal probation for second and subsequent offenders), high fines and fees ranging between $1,800.00 and $3,600.00, and significant jail time.
Although there is no guarantee that you will get Diversion in Veterans Court, hiring an attorney like Ms. McQueen, who is well-versed in the requirements for Diversion and who regularly appears in Vet Court, will increase your chances of obtaining Diversion. We want to do everything possible in order to get a grant of Diversion.
DUI Reduced to Wet Reckless
Many DUI cases in Ventura County that are not defensible, may still qualify for a reduction to a Wet Reckless. A Wet Reckless is a highly desirable outcome for cases that are not defensible, because a conviction for a Wet Reckless in court does not result in mandatory DMV action, unlike a DUI. The DMV can sometimes suspend you on the DMV hearing side of the equation, in an Administrative Per Se Hearing, but if a case qualifies for a reduction to a Wet in court, those DMV/APS hearings are often winnable as well.
In addition, the probationary period for a Wet Reckless is only one year, verses three years for a first-time DUI conviction, and the fines and fees are significantly lower than those of a DUI (well over $1,000.00 less). Finally, the possible jail penalties are also greatly reduced. Although a Wet Reckless does count as a prior DUI if you receive another DUI within 10 years (calculated offense date to offense date), it is in your power to prevent that from happening.
You have the greatest chance of obtaining Veterans Court Diversion, and/or getting a DUI case reduced to a Wet Reckless when you retain a skilled attorney like Mindy H. McQueen. Her practice is limited to DUI defense in Ventura County, and she knows the best way to pursue these outcomes.
The blood sample can be drawn or stored improperly, or it may be tainted with improper levels of preservatives, all of which can give a false BAC result. If the blood test results are truly suspect, a blood-split should be done to confirm the results.
